Thank you for visiting our site which is owned and operated by American Identity Group (“American Identity Group, LLC” “we,” “us,” “our”). These Terms of Use (“Terms”) set forth a legally binding contract which governs (1) your use of all websites, portals, and pages owned or operated by us, including those accessible through the domain and subdomain: americanidentitygroup.com (the “Site”), and (2) your interactions with our services offered through the Site (the “Services”), which include: Identity Theft Services and products, and offers that we may make available to you. 

Please read these Terms carefully before continuing to access the Site or using the Services. By accessing the Site or using the Services, you agree to be bound by these Terms and the Privacy Policy.

PLEASE BE ADVISED THAT THESE TERMS CONTAIN PROVISIONS THAT GOVERN HOW DISPUTES BETWEEN US ARE RESOLVED, WHICH INCLUDES AN AGREEMENT TO ARBITRATE DISPUTES, CLASS ACTION WAIVER, AND JURY TRIAL WAIVER. PLEASE READ ALL THESE PROVISIONS BEFORE USING THE SITE.

1. General Uses and Restrictions

Unless otherwise noted, the Site and Services are intended for personal, non-commercial purposes only. You agree to use the Site and Services only for lawful, noncommercial purposes and in compliance with all international, federal, state, and local laws. Except as expressly permitted in these Terms, you may not use, reproduce, distribute, reverse engineer, modify, copy, publish, display, transmit, adapt, frame, link, rent, lease, loan, sell, license or in any way exploit the Site and/or the Services.

By accessing the Site, you represent and warrant that you (a) are above the legal age of majority in your jurisdiction of residence; (b) have not previously been suspended or removed from the Site; (c) do not have more than one account at any given time for the Site; (d) will only provide us with true, accurate, current, and complete information if you register for an account and/or use the Services; and (e) have full power and authority to enter into these Terms. We reserve the right to refuse and/or withdraw access to the Site and Services if you violate these Terms and/or applicable laws. 

You agree to provide true, accurate, complete and current information to American Identity Group about yourself and any minor children you are enrolling or have enrolled in the Site or any Services. If American Identity Group determines or reasonably suspects that any information you provided to American Identity Group is false, incomplete or inaccurate, American Identity Group may, in its sole discretion, suspend or terminate your access to and use of the Site and Services and block all future access to and use of the Site and Services. You further agree that American Identity Group will not be liable to you, your minor children, or any other person if American Identity Group suspends or terminates your access to and use of the Site and Services.

You understand and agree that by purchasing the American Identity Group Services you are providing “written instructions” in accordance with the Fair Credit Reporting Act, as amended from time to time (“FCRA”), for American Identity Group to access and obtain your personal credit information, and the personal credit information of any minor(s) you have enrolled, from any or all of the credit reporting companies for the purpose of verifying your and any enrolled minor’s identity and to provide the Services and any services or functions related thereto and American Identity Group business.

American Identity Group shall not be obligated or responsible for providing Services for any request based on: (i) an act of fraud, deceit, collusion, dishonesty or criminal act by you or any person acting in concert with you; (ii) authorized charges that you have disputed based on the quality of goods or services; (iii) authorized account transactions or trades that you have disputed, or are disputing, based on the execution (or non-execution) of electronic transfers, trades or other verbal or written instructions or directions; (iv) losses, damages or expenses arising out of any business pursuits; (v) losses, damages or expenses that were incurred or commenced prior to the effective date of your Services order confirmation; or (vi) theft, loss or damage related to, without limitation, travelers checks, tickets of any kind, negotiable instruments, cash or its equivalent, passports, documents or real property.

When purchasing from us, your order is accepted only when your payment is accepted, and we send you a confirmation email.  If the payment method you provide cannot be verified, is invalid or is otherwise not acceptable, your order may be suspended or cancelled.  If we reject your order, we will refund any payments made for the current service period, and we may also cancel or restrict access to the applicable offering.  

2. Prohibited Uses

You agree not to use the Site to:

  1. violate any applicable law;
  2. send unsolicited marketing materials, including junk email, spam, or chain letters;
  3. post, transmit, or otherwise make available any material that is (a) threatening, harassing, degrading, hateful or intimidating; (b) defamatory, libelous, fraudulent, or otherwise tortious; (c) obscene, indecent, pornographic, or otherwise objectionable; or (d) protected by a third party’s copyright, trademark, trade secret, right of publicity or privacy, or any other proprietary right without the express prior written consent of the applicable owner;
  4. post, insert, transmit, or otherwise make available any malicious or harmful software that is intended to (a) make unauthorized changes to or cause damage to any hardware, software, or equipment; (b) copy, provide unauthorized access to, or prevent authorized access to confidential information or personal information; or (c) prevent detection of any unauthorized invasion of any hardware, software or equipment;
  5. harvest or collect information about users of the Site;
  6. interfere with or disrupt the operation of the Site;
  7. reproduce, copy, modify, adapt, translate, create derivative works of, sell, resell, license, sublicense, rent, lease, loan, distribute, or otherwise exploit any portion of the Site except as expressly authorized by us;
  8. reverse engineer, decompile, or disassemble any portion of the Site;
  9. remove any copyright, trademark, or other proprietary notices from the Site;
  10. frame or mirror any portion of the Site, or otherwise incorporate any portion of the Site into any product or service;
  11. systematically download and store data from the Site or Services; and
  12. use manual or automated software, devices, scripts, robots, or other means or processes to access, “scrape,” “crawl,” or “spider” the Site or Services.

3. Consent to Access Personal Information

In order to provide you with your requested Services, American Identity Group, its Affiliates, and its Service Providers require access to personal information that may be protected under the Gramm-Leach Bliley Act, the Drivers Privacy Protection Act, and any laws regulating DMF information. By agreeing to these Terms, you understand and acknowledge that you are providing consent to allow American Identity Group, its Affiliates, and its Services Providers to access your personal information for the purpose of providing you your requested Services. You may withdraw your consent at any time by contacting American Identity Group Customer Service Department. However, any revocation of consent to access your personal information may prevent us from providing you Services.

4. Product Specific Terms

Identity Monitoring. The Identity Monitoring Service proactively scans for sensitive personal information commonly sold and traded on black market internet sites and chat rooms. This service includes monitoring for credit and debit card numbers, bank account numbers, social security numbers, driver’s license numbers, telephone numbers, email addresses, and other sensitive information. The service uses the latest internet crawling and monitoring technologies, private and public security professionals, and law enforcement agents to identify new black-market internet sites for monitoring. The service uses industry standard encryption and security processes to maintain data security and monitoring reliability.

Title Monitoring. The Title Monitoring Services utilize our monitoring algorithms to search for new deed and title record information on properties using the property address, name, and SSN that you provide. We scan county records nationwide and generate an alert when a new property is detected matching personal information, there is a change in ownership on one of the previously identified properties, a new claim is made to one of your previously identified properties, or a lender files an update to their financing agreement that matches either their personal information, or one of their previously identified properties.

Credit Monitoring. By enrolling in our Credit Monitoring Services, TransUnion Credit Monitoring will watch your TransUnion, Experian® and Equifax® credit reports, and alert you whenever there are critical changes to your accounts, such as new accounts being opened in your name, a credit card balance increase, or negative information like a late payment reported by one of your creditors. The Credit Monitoring Services also include help with establishing credit security freezes on your credit profiles at TransUnion, Experian® and Equifax® to prevent credit reporting agencies from releasing your credit report information without your consent. Through these Services, you will also receive free credit report reminders and assistance with obtaining a free yearly credit report.

Removal Services. Through enrollment in Privacy Protect, we scour the web, including data brokers, people search sites, social media, search engines and more, to find where you might have accessible information like your phone number, email address, family member, government records and more that you may not want or could put you at risk.

Recovery Services are provided by American Identity Group or an approved American Identity Group vendor. Eligibility for recovery services is based on identity theft events that are discovered and reported to American Identity Group during the eligibility period. If you were the subject of a stolen identity event prior to the effective date of your enrollment for recovery services, you are not eligible to purchase the recovery services American Identity Group Products and Services offered by American Identity Group. If you are coping with a known identity theft event at the time of enrollment, you may call American Identity Group Customer Service department to receive a quote on recovery services appropriate for your situation. Businesses are not eligible for recovery services. American Identity Group does not provide credit counseling or repair to credit that legitimately belongs to the primary member, their spouse or significant other. Recovery Services expressly exclude the provision of any and all services in relation to a legal action to establish title against adverse claims to real or personal property or any interest therein (common referred to as Quiet Title actions). The successful completion of the recovery services described herein depends on the cooperation of the member. Such cooperation may include providing requested information (including personal information), providing power of attorney, allowing access to your personal accounts, and sharing communications with relevant parties. American Identity Group reserves the right to refuse or terminate American Identity Group Products and Services if it is deemed that the member is committing fraud or other illegal acts, making untrue statements, or failing to perform his/her portion of the recovery plan. American Identity Group will not refuse or terminate services based solely on the complexity of the case.

Reimbursement Plan, if applicable, is provided by a leading insurance company in the United States. Refer to the Evidence of Coverage for the plan you have purchased for specific coverage amounts, exclusions and other terms.

General Exclusions:

  • Only pays for losses incurred in the United States.
  • Dishonest Acts: Any dishonest, criminal, malicious or fraudulent acts if the insured that suffered a loss personally participated in, directed, or had prior knowledge of such acts.
  • Bodily Injury: Any physical injury, sickness, disease, disability, shock, mental anguish, and mental injury, including, required care, loss of services or death at any time resulting there from.
  • War: Strikes or similar labor action, war (whether declared or not), or any act or condition incident to war. War includes civil war, insurrection, act of foreign enemy, civil commotion, factional civil commotion, military or usurped power, rebellion, revolution, invasion, hostilities or warlike operations or mutiny.
  • Pollution: Claims alleging or arising out of the presence of or the actual, alleged or threatened discharge, dispersal, release or escape of pollutants (including nuclear materials), or any direction or request to test for, monitor, clean up, remove, contain, treat, detoxify or neutralize pollutants, or in any way respond to or assess the effects of pollutants.
  • Late Reporting: Any loss reported to us more than six (6) months after a stolen identity event occurs.

5. Family Plan Coverage

You will be enrolled in Family Plan Coverage by default. Family Plan Coverage allows your spouse or domestic partner, your dependents, and your parents to utilize the Services that you are enrolled in, provided that each individual is registered at your same permanent address. Family Plan Coverage is also dependent upon verification of each individual’s identity and proof of residence, which may require you to provide social security cards, birth certificates, and proof of residency.

6. Product Fees and Payment

If you are paying for Services through an authorized reseller of American Identity Group Services (“Reseller”), then please refer to the payment and cancellation terms in your agreement with the Reseller. 

If you are paying for Services directly toAmerican Identity Group, then the following terms will apply:

Charges – Based on your authorization, payments will be deducted from your credit or debit card on a monthly frequency in the amount indicated. Alternatively, you may elect to pay by check by providing us with informed consent. With sixty (60) days prior written notice to you at the email address on file for the primary member, American Identity Group reserves the right to adjust the pricing. You are under no obligation to continue the program (see Cancellation below).

Cancellation – If you wish to cancel your plan, please call the customer service number. Your plan will be cancelled at the end of the month in which the cancellation request is received. You are responsible for making payment for the months during which are in effect.

Lapse for Non-Payment – If payment is not received on the due date for the benefit period you elected, a notice of cancellation (“Notice of Cancellation”) will be sent to you. If payment is not received within ten (10) days after the initial Notice of Cancellation is sent, the plan may be terminated, effective on the last day of the month for which payment has been made. If the member, or a qualifying family member, is engaged in the recovery process an attempt will be made to contact the member by phone in addition to the email Notice of Cancellation. American Identity Group Services will cease at the point at which the plan is terminated for non-payment.

7. Submitting a Claim for Reimbursement

In the event that you incur covered expenses as part of an identity theft event, your recovery advocates will provide initial contact information to the insurance carriers that provide the reimbursement plan, if applicable. You will be mailed an insurance company claim package. For a detailed description of expenses eligible for reimbursement, see the description of the reimbursement plan.

8. User Content

If you send us reviews, surveys, creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, “User Content”), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any User Content; or (3) to respond to any User Content.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms.

You agree that your User Content will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your User Content will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any User Content. You are solely responsible for any User Content you make and its accuracy. We take no responsibility and assume no liability for any User Content posted by you or any third-party.

9. Ownership

As between you and us, we own the intellectual property rights to the Services and the contents of the Site, excluding User Content. 

The Services and contents of the Site may not be copied, distributed, republished, uploaded, posted, or transmitted in any way without our prior written consent.  You may not remove, alter, or cause to be removed or altered, any copyright, trademark, trade name, service mark, or any other proprietary notice or legend appearing on the Services or Site. We retain all rights, title, and interests in the Services and the Site’s contents unless expressly stated otherwise.

10. Infringement

You acknowledge and agree that the Site and Services, including, without limitation, formulae, specifications, pricing, content, applications, trademarks, graphics, photographs, information, software, including, without limitation, source and object code, scripts, promotions, events, programs and interactive features provided by or for American Identity Group, whether in whole or in part, (individually and collectively, “American Identity Group Intellectual Property”) is owned by and is the exclusive property of American Identity Group or its licensors, subject to trademark, copyright, patent, trade secret and other intellectual property rights and laws. You further agree that you have no right, title or interest in American Identity Group Intellectual Property and that you shall not use any American Identity Group Intellectual Property without American Identity Group prior written consent. You hereby grant to American Identity Group and Affiliates a non-exclusive, perpetual, irrevocable, transferable, worldwide, royalty-free, fully paid-up, right and license to use, copy, modify, transfer and distribute your personal information to provide the Services.

12. Disclaimers

12.1 Disclaimer of Warranties
THE SITE, SERVICES, AND ALL INFORMATION, PROGRAMS, SOFTWARE, AND MATERIALS AVAILABLE ON OR THROUGH THE SITE ARE PROVIDED “AS IS.” WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE REGARDING THE SITE OR THE SERVICES. AIG DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED OR EXPRESS WARRANTIES OF (I) MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR QUIET ENJOYMENT, (II) ARISING OUT OF ANY COURSE OF DEALING OR USAGE OF TRADE, (III) THAT THE SITE WILL BE UNINTERRUPTED, ERROR FREE OR FREE OF HARMFUL COMPONENTS, AND (IV) THAT ANY CONTENT WILL BE SECURE OR NOT OTHERWISE LOST OR ALTERED.

12.2 General Service Limitations
American Identity Group title monitoring and title recovery services are detection and assistance services only and do not prevent title fraud, property fraud, or deed theft. Our services are designed to alert you to potential fraudulent activity affecting your property title and to assist in the recovery process if such activity occurs. We do not guarantee that all fraudulent activity will be detected or that recovery efforts will be successful.

12.3 Not Title Insurance
American Identity Group Services are not title insurance and do not replace the need for title insurance. Title insurance protects against defects in title that existed prior to the issuance of the policy, while our monitoring services alert you to potential changes to your title after you enroll in our services.

12.4 Recovery Assistance Scope
Our recovery assistance services provide guidance and support in addressing fraudulent title activity but do not guarantee successful resolution of all issues. Recovery may require legal action, which is not provided as part of our services. The ultimate responsibility for taking legal action remains with you.

12.5 No Attorney-Client Relationship
American Identity Group is not a law firm, and our representatives are not acting as your attorneys. Our services do not create an attorney-client relationship, and any information provided by us should not be considered legal advice. For legal advice, you should consult with a licensed attorney.

13. FCRA Disclosures

The FCRA allows you to obtain a copy of all of the information in your consumer credit file disclosure from any consumer credit reporting company for a reasonable charge. Failure to comply with the FCRA can result in state or federal enforcement actions, as well as private lawsuits. In addition, any person who knowingly and willfully obtains a consumer credit report or disclosure under false pretenses may face criminal prosecution. The FCRA also states that individuals are entitled to receive a disclosure directly from the consumer credit reporting company free of charge under the following circumstances:

 

  • You have been denied credit, insurance or employment in the past sixty (60) days as a result of your report
  • You certify in writing that you are unemployed and intend to apply for employment in the sixty (60)-day period beginning on the day you make the certification
  • You are a recipient of public welfare assistance
  • You have reason to believe that your file at the agency contains inaccurate information due to fraud

 

The FCRA allows consumers to get one (1) free comprehensive disclosure of all of the information in their credit file from each of the three (3) national credit reporting companies (Experian, Equifax, and TransUnion) once every twelve (12) months through a central source. Georgia residents can receive two (2) disclosures per year. Although comprehensive, the credit reports from each of the three (3) national credit reporting companies that are available from American Identity Group may not have the same information as a credit report obtained directly from the three (3) national credit reporting companies or through the central source. To request your free annual report under the FCRA, you must go to www.annualcreditreport.com, or call 877-322-8228

American Identity Group Products are not related to the free FCRA disclosure that you are or may be entitled to.

The FCRA also permits consumers to dispute inaccurate information in their credit report without charge. Accurate information cannot be changed. You do not have to purchase your credit report or other information from American Identity Group to dispute inaccurate or incomplete information in your credit file or to receive a copy of your consumer disclosure.

The credit reports you are requesting from American Identity Group are not intended to constitute the disclosure of the credit reporting company’s information required by the FCRA or similar state laws. The credit reporting company’s disclosure report must be obtained directly from the credit reporting company by contacting the credit reporting company as show below:

14. Indemnification

You agree to defend, indemnify, and hold harmless American Identity Group, its affiliates, officers, directors, members, managers, employees, agents, licensors, clients, and subcontractors from and against any and all claims, damages, losses, liabilities, costs, and expenses relating to or arising from (i) your use of the Site or Services, (ii) your violation of the Terms, (iii) your violation of any third party rights relating to or arising out of your use of the Site or Services, or (iv) your violation of any law or regulation relating to, or arising out of, your use of or access to the Site or Services.

15. Limitation of Liability

AMERICAN IDENTITY GROUP AND ITS MEMBERS, MANAGERS, AFFILIATES, EMPLOYEES, OFFICERS, AGENTS, AND DIRECTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, AGGRAVATED, OR PUNITIVE DAMAGES OF ANY KIND, UNDER ANY CONTRACT, TORT, STRICT LIABILITY, OR OTHER THEORY, OR DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA OR OTHER INTANGIBLES, OR LOSS OF SECURITY OF SUBMITTED MATERIALS, EVEN IF ADVISED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES. 

WITHOUT LIMITING THE FOREGOING, YOU FURTHER AGREE THAT AIG WILL NOT BE LIABLE FOR DAMAGES OF ANY KIND RESULTING FROM YOUR USE OR INABILITY TO USE THE SITE OR FROM ANY THIRD-PARTY MATERIALS, INCLUDING FROM ANY MALWARE OR ANY VIRUS, WORM, HACK, OR MALICIOUS SOFTWARE THAT MAY BE TRANSMITTED IN CONNECTION THEREWITH. 

YOU ACKNOWLEDGE THAT YOUR SOLE AND EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE SITE IS TO STOP USING THE SITE. 

NOTWITHSTANDING THE FOREGOING, YOU AGREE THAT THE MAXIMUM AGGREGATE LIABILITY OF AIG FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION RELATING TO YOUR USE OF THE SITE OR SERVICES WILL BE $100.

16. Dispute Resolution

16.1 General
In the interest of resolving disputes in the most expedient and cost effective manner, you and American Identity Group agree that any dispute arising out of or in any way related to these Terms, your relationship with American Identity Group, or any goods or services offered or provided by American Identity Group, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of whether a claim arises during or after the termination of these Terms, will be resolved by binding arbitration. Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and can be subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND AIG ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND THAT THESE TERMS WILL BE SUBJECT TO AND GOVERNED BY THE CALIFORNIA ARBITRATION ACT.

16.2 Exceptions
Notwithstanding Section 14.1, nothing in these Terms will be deemed to waive, preclude, or otherwise limit the right of either party to: (a) bring an individual action in small claims court;
(b) seek injunctive relief from a court of competent jurisdiction; or (c) to file suit in a court of law to address an intellectual property infringement claim.

16.3 Arbitrator
Any arbitration between you and AIG will be governed by the New Jersey Arbitration Act and the JAMS Comprehensive Arbitration Rules & Procedures (collectively, “JAMS Rules”), and will be administered by JAMS. The JAMS Rules and filing forms are available online at www.jamsadr.com, or by calling JAMS at 1-800-352-5267. The arbitrator has exclusive authority to resolve any dispute relating to the interpretation or enforceability of this binding arbitration agreement. Any disputes regarding arbitrability shall be determined by a court of competent jurisdiction.

16.4 Notice; Process
A party who intends to seek arbitration must first send a written notice of the dispute to the other party by U.S. Mail (“Notice”). American Identity Group address for Notice is set forth in Section 17.4. The Notice must: (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought. The parties will make good faith efforts to resolve the claim directly but, if the parties do not reach an agreement within thirty (30) days after the Notice is received, you or American Identity Group may commence an arbitration proceeding.

16.5 Fees
Each party shall pay its pro rata share of JAMS fees and expenses as set forth in the JAMS fee schedule, unless the parties agree on a different allocation of fees and expenses. If the action qualifies as a consumer arbitration, the JAMS Policy on Consumer Arbitrations shall apply.

16.6 Conduct of Arbitration
Any arbitration hearing will take place at a JAMS office in New Jersey. The arbitrator must issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the decision and award, if any, are based. Each party agrees that such written decision, and information exchanged during arbitration, will be kept confidential except to the extent necessary to enforce or permit limited judicial review of the award.

16.7 No Class Actions
YOU AND AMERICAN IDENTITY GROUP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and American Identity Group agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Jersey without giving effect to any choice or conflict of law provision or rule. Any action against American Identity Group that is not subject to mandatory arbitration, as set forth in Section 14, shall be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey.

18. SMS Messages

18.1 SMS Program
We provide communications via SMS concerning products, sales, order status, promotional offers, and upcoming events (the “SMS Program”). If you opt in to our SMS program, these Terms shall apply.

18.2 User Opt In
The SMS Program allows you to receive SMS mobile messages by providing your phone number to us and/or affirmatively opting into the SMS Program, such as through online or application-based enrollment forms. Regardless of the opt-in method you utilized to join the SMS Program, you agree that these Terms apply to your participation in the SMS Program. By participating in the SMS Program, you agree to receive autodialed or prerecorded marketing mobile messages at the phone number associated with your opt-in, and you understand that consent is not required to do business with us. While you consent to receive messages sent using an autodialer, the foregoing shall not be interpreted to suggest or imply that any or all of our mobile messages are sent using an automatic telephone dialing system (“ATDS” or “autodialer”). Message and data rates may apply. Message frequency varies.

18.3 User Opt Out
If you do not wish to continue participating in the SMS Program, you agree to reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message from us in order to opt out of the SMS Program. You may receive an additional mobile message confirming your decision to opt out. You understand and agree that the foregoing options are the only reasonable methods of opting out. You acknowledge that our text message platform may not recognize and respond to unsubscribe requests that alter, change, or modify the STOP, END, CANCEL, UNSUBSCRIBE or QUIT keyword commands, such as the use of different spellings or the addition of other words or phrases to the command, and agree that American Identity Group and its service providers will have no liability for not honoring such requests. You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out.

18.4 Cost and Frequency
Message and data rates may apply. You agree to receive messages periodically at our discretion. Daily, weekly, and monthly message frequency will vary. The SMS Program involves recurring mobile messages, and additional mobile messages may be sent periodically based on your interaction with us.

19. General Provisions

19.1 Entire Agreement
These Terms constitute the entire agreement between you and AIG relating to the Site. These terms supersede any and all prior or contemporaneous agreements or understandings between you and American Identity Group.

19.2 Severability
If any provision of these Terms is found to be invalid by a court of competent jurisdiction, the provision shall be stricken. All other terms will remain in full force and effect.

19.3 Waiver
No failure to exercise, or delay in exercising any rights, remedy, power, or privilege arising from these Terms will operate or be construed as a waiver thereof. Likewise, no single or partial exercise of any right, remedy, power, or privilege hereunder will preclude any other or further exercise thereof or the exercise of any other right, remedy, power or privilege.
